Conditions of Sales

1/Generality:

The general conditions of sales described below are an integral part of every contract or service negotiated between the customer or the customer agency (commonly named « Client » below) and VINH HY BLUESKIES TOURISM (named « VH BLUESKIES » below). The approval by the Client of a contract with VH BLUESKIES implies that the Client has red, understood and agreed to the conditions and policies mentioned in the general conditions of sales.

2/Validity of the offers:

All prices mentioned in the VH BLUESKIES invoice are in Vietnam Dong. These prices are valid for as long as mentioned in the pricing, the invoice or any document given by VH BLUESKIES to the Client. VH BLUESKIES guarantees the validity of the rates, invoices or documents given to the Client at the moment they were given. The rates can be readjusted in case of force majeure (important variation of the exchange rate, new state tax…) and this with or without prior notification from ours side, VH BLUESKIES cannot decently realize the travel plan at the initial rates. In these cases, a request of price readjusting will be sent to the Client by VH BLUESKIES, the Client can either agree with or reject this request. In case of rejection by the Client, VH BLUESKIES can cancel the tour and has to refund the deposit paid by the Client.

3/Bookings and confirmations:

All bookings have to be sent to VH BLUESKIES via email. As soon as a tour is confirmed, the inscription implies a payment of a deposit of 30% of the total cost of the tour, the balance can be paid up to one month prior departure, or at the latest, on the first day of the trip and this only after our approval. If these requirements aren’t met, VH BLUESKIES can cancel the tour and refund part of the deposit paid by the client or even keep it in its totality. In case of inscription less than a month prior departure, the totality of the price has to be paid at the moment of inscription. As soon as the service has been confirmed, an invoice will be issued by VH BLUESKIES and sent to the Client via email.

 

4/Payment method:

VH BLUESKIES’s bank account details will be given to the Client when the final contract is established.

In order to pay the deposit of 30%: either by bank transfer (bank fees to be paid by the Client) or by credit card (Visa, Mastercard, American Express, JCB, with fees of 3% to be paid by the Client) or at the VH BLUESKIES headquarters: in cash (no fees) 

To pay the balance: use the same method as for the deposit. To avoid any additional fees you can pay in cash upon arrival.

Note: If you pay by credit card the amount will be calculated in Vietnam Dong (in accordance with the bank system of the country) on the basis of the exchange rate on the day of payment.

5/Amendment of the request or the services:

Any major amendment has to be sent by the client at least one month prior departure. The amendment of the travel plan during the tour is possible depending on availability of the requested services and potentially the payment of additional fees.

6/Cancelation:

6.1. Cancelation by the Client

In case of cancelation by the Client and this under any circumstances, the Client commits to pay the following cancelation fees:

More than 30 days prior departure: 20% of the total cost of the tour;

From 15 to 30 days prior departure: 40% of the total cost of the tour;

From 3 to 7 days prior departure: 60% of the total cost of the tour;

Less than 3 days prior departure: 90% of the total cost of the tour.

During the tour, 100% of the total cost of the tour.

 

This rule isn’t applicable for bookings of train or plane tickets and other special services (the client will be informed of this when concluding the contract for services), cancelation will engender the fees negotiated with the service provider.

The refunds paid by VH BLUESKIES to the Client will be made via bank transfer and the Client has to pay all bank fees.

6.2. Cancelation by VH BLUESKIES

The contract delivered by VH BLUESKIES can be cancelled in case of force majeure: politics, sanitary, natural disaster, plane, etc… In any case of cancelation by VH BLUESKIES, every registered person will be fully refunded but cannot pretend to receive any compensation.

7/Administrative formalities such as Passport and Visa:

Prior inscription to a tour, you have to make sure that each traveler has in his possession a valid passport (valid for at least 6 month after return date) and meets all the visa requirements of the Socialist Republic of Vietnam.

8/Insurance – Support:

Every person who participates in a tour organized by VH BLUESKIES has to subscribe to an international travel insurance. This insurance is generally purchased by the Client in his home country, eventually with some advice from VH BLUESKIES, and has to be confirmed before the beginning of the tour. VH BLUESKIES commits to provide useful support to the Client in case of event covert by the Client’s insurance, such as accomplishing all the formalities mentioned in the Client’s insurance policy.

9/Responsability:

VH BLUESKIES commits to provide to the Client all services mentioned in the invoice/contract given by VH BLUESKIES. During the tour, the Client has to respect the rules stated by the tour-guide or the service provider. Everything that occurs out of the contract or the travel program isn’t under VH BLUESKIES’s responsibility. VH BLUESKIES is responsible as a middle man between his Client and the different service providers (hotel, transportation, restaurants, boats, etc…), VH BLUESKIES has to do everything in its power to satisfy the Client, but cannot be involved in any action made by the service providers who are responsible for their own doings.

Delays, losses, accidents, damages, unpleasant changes, natural disasters, political changes, civil unrest… due to cause independent of our will, are not the responsibility of VH BLUESKIES.

10/Complains:

The two sides commit to follow the hereby mentioned rules and conditions. In case of misunderstanding, the two sides commit to look for a mutual agreement respecting both sides. In case the negotiation isn’t successful, the final decision will be made by Vietnam via the Vietnam International Arbitral Center (VIAC) at the Vietnam Chamber of Commerce and Industry (VCCI) of the Socialist Republic of Vietnam. All complaints have to be submitted to our office, by registered letter with receipt confirmation 30 days after the end of services at the latest, VH BLUESKIES will not take any responsibility for all complaints received later than 30 days after the end of the services.
